Welcome to Holipix! By accessing or using our website, services, and photo library (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.
1. Acceptance of Terms
By using Holipix, you confirm that you are at least 18 years old or have legal parental/guardian consent. If you do not agree to these Terms, you may not access or use our Service.
2. Use of the Service
Holipix provides a platform for discovering and downloading free holiday, travel, and festive-themed photography. You are granted a limited, non-exclusive, non-transferable license to access the site for personal or commercial use in accordance with our License Agreement.
Prohibited Activities:
- Using automated scripts, bots, or scrapers to download images in bulk.
- Interfering with the security or integrity of the website.
- Uploading content that is illegal, offensive, or infringes on the intellectual property of others.
3. Intellectual Property Rights
- Our Content: All text, graphics, logos, and software on Holipix are the property of Holipix or its content suppliers and are protected by international copyright laws.
- Photographer Content: Photos remain the intellectual property of the original contributors. By downloading an image, you are granted a license to use it, but ownership is not transferred to you.
4. User Accounts
To contribute photos or access certain features, you may be required to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Providing accurate and up-to-date information.
5. Contributor Terms
If you submit photos to Holipix, you grant us a worldwide, perpetual, irrevocable, royalty-free license to host, display, and distribute those photos. You represent that you own all rights to the photos and have obtained any necessary model releases.
6. Limitation of Liability
Holipix is provided on an “as-is” and “as-available” basis. We do not guarantee that the Service will be uninterrupted or error-free. To the maximum extent permitted by law, Holipix shall not be liable for any direct, indirect, or incidental damages resulting from your use of the Service or images downloaded from the platform.
7. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
8. Changes to Terms
Holipix reserves the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our homepage or via email. Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Holipix operates, without regard to its conflict of law provisions.
